Benefits of Building an ADU in San Jose

The main benefits of building an ADU in San Jose are rental income, a separate home for family close by, and added property value. How much you gain depends on the type of ADU you build and on what your lot allows, so this guide covers the eleven benefits, the four ADU types, and the city rules that shape each one.

Each benefit, and what it means in San Jose

1. Rental income

For many owners the most attractive feature of an ADU is the rent it can bring in. In a high-demand rental market, a well-designed unit can also command a stronger rent. A well-designed ADU in San Jose can generate $2,000-$4,000+ per month in rental income, often covering your mortgage. Rent beyond that can go toward property taxes, which makes the house more affordable to keep.

San Jose’s rules for ADU rental income are straightforward: you may build an ADU where the house itself is rented, and you may rent the house and the ADU to different parties. You choose your tenant, but fair housing law applies, and state law sets a minimum rental term of 30 days, including on Airbnb, so an ADU is a long-term rental rather than a nightly one.

2. Multigenerational living

An ADU lets parents, grandparents or grown children live close by while each household keeps its own front door, kitchen and routine. Everyone gets privacy, and the family stays together.

3. Increased property value

An ADU adds living space, and buyers see a second unit as an attractive feature, so it can make a property stand out. A 2021 analysis by Porch.com, reported by the National Association of Realtors, found that in the largest U.S. cities homes with an ADU were priced 35% higher on average than homes without one. Your own result depends on the unit, the lot and the market.

Property taxes rise with it: the City of San Jose notes that your taxes increase based on the value of the ADU, and the County Assessor handles the details.

4. Flexibility in use

An ADU can be a guest suite, a home office, an art studio or a gym today, a rental next year, and a home for a parent later. That ability to change use as your life changes is one of its biggest advantages. One limit to know: in San Jose an ADU cannot be sold on its own unless the property first goes through a condominium conversion.

5. Affordable housing

Housing affordability is a problem in most of the country, and the Bay Area feels it sharply. ADUs add rental homes inside established neighborhoods without new subdivisions, which is why the City of San Jose lists creating more affordable housing among their main benefits. Renting your unit at a fair price eases the pressure on others while creating income for you.

6. Aging in place

An ADU is a practical way to stay in a familiar neighborhood as you get older. You can move into the smaller, single-level unit and rent out the main house, keeping your social connections and adding an income at the same time.

7. Lower construction costs

Compared with building a traditional house, an ADU is relatively cost-effective: it is smaller, uses fewer materials and less labor, and carries lower fees. Converting an existing structure, such as a garage, can cost less still.

In San Jose two choices lower the cost further. ADUs under 750 square feet are not charged school or parkland impact fees, and the city’s Preapproved ADU plans have already been reviewed by city staff, which lowers review cost and time. Preapproved plans are not available on lots in a geologic hazard, landslide, flood or wildland-urban interface zone. For budgets, see ADU cost in San Jose.

8. Quicker approval

Many local governments have recognized the benefits of ADUs and streamlined their permits, so in some areas an ADU can be approved faster than a traditional addition or new house. San Jose says the first round of building review typically takes 20 business days, and that complete, accurate plans prepared by a professional who knows the city’s ADU process are the best way to stay within one or two review cycles. The city also has a named ADU contact, the “ADU Ally”, reachable by email and phone through the Permit Center.

9. Tax benefits

If you rent out the ADU or use it as a business office, there may be tax advantages, such as depreciating the unit over time and deducting construction and maintenance costs. The details depend on your situation, so speak with a tax accountant to find out what you are eligible for.

10. Sustainable living

ADUs use less land and fewer materials than new houses on new land, and a compact unit needs less energy to heat and cool, which lowers utility bills and emissions. Building on lots that already have streets, sewers and transit is what planners call infill, and San Jose lists promoting infill and encouraging public transportation among the reasons it supports ADUs.

11. Ideal size for modern households

Smaller households often need less space than a full house, and an ADU is sized for them. As a reference, the plans on San Jose’s Preapproved ADU list range from about 476 to 799 square feet, with one or two bedrooms and one or two bathrooms.

Which ADU type fits your lot

We build four types of ADU: Detached ADUs, Attached ADUs, Garage Conversions (JADU) and Two-Story ADUs. The right one depends on your lot, your budget and how much privacy the unit needs.

TypeBest forSan Jose notes
Detached ADURentals and the most privacyFire access matters: every part of the unit should be within 150 feet of the curb along a 4-foot clear path (otherwise a fire variance may be needed), and the city checks that every exterior wall is within 600 feet of a hydrant. The unit gets its own address, and PG&E now requires its own meter.
Attached ADUFamily members who want independence but closenessIf the house has fire sprinklers, the ADU needs them. An attached ADU over 500 square feet, where the house and ADU together exceed 3,600 square feet, requires sprinklers in both.
Garage Conversion (JADU)The lowest-cost path, often for a parent or adult childA junior ADU is under 500 square feet and sits within the existing footprint of the house, which can include an attached garage. It needs a recorded deed restriction and no separate utility meter.
Two-Story ADUSmall lots where floor area is needed but yard space is shortHeight and setback limits come from the city’s ADU Universal Checklist, so confirm them for your lot before design.

For conversions, see garage conversion in San Jose. For the full service, see our ADU builders page. If what you need is more room in the main house rather than a separate unit, compare with home additions.

Is an ADU worth it? Five questions to answer first

  1. What will it be for, now and in ten years? A rental, a parent’s home and an office need different layouts, entrances and privacy.
  2. Does your lot qualify? San Jose’s ADU Universal Checklist covers which lots qualify, setbacks, height and fire requirements. Complete it before paying for design.
  3. Is the lot in a hazard zone? Look up the address on SJPermits.org. Flood, geologic hazard or wildland zones add requirements and rule out the preapproved plans.
  4. Can utilities and fire access reach it? A water flow letter from your water company is part of the submittal, and the city says it is a common cause of delay, so request it early.
  5. Do the numbers work? Compare the build cost with the rent or the family benefit you expect, and include the higher property tax. Our ADU cost guide explains what drives the price.

ADU questions homeowners ask

Does adding an ADU increase property taxes in California?

Yes, but only for the value the ADU adds. Only the added value that the ADU brings to your property increases your property taxes, not the value of the overall property; the City of San Jose likewise says taxes increase based on the value of the ADU.

Can I rent my San Jose ADU on Airbnb?

Not as a nightly rental. State law sets a minimum rental term of 30 days for ADUs, including Airbnb listings, so short stays of a few nights are not allowed.

Can I sell the ADU separately from the house?

Only after a condominium conversion. San Jose requires you to apply to convert the house and ADU to condominiums before an ADU can be sold on its own.

Does an ADU need its own address and utility meter?

It gets its own address, assigned during the building permit process. PG&E now requires a separate meter for ADUs, so confirm the requirement with PG&E early; a junior ADU is not a separate unit and does not need its own meter.
